Acceptable Use Policy
This Acceptable Use Policy ("AUP") governs how Customers may access and use the services, data, software, and related materials (the "Service") provided by Real Estate Intent, a service of Next Level Web Design LLC ("Company," "we," "us," or "our").
This AUP includes additional requirements for Customers operating in or involving California residents.
By accessing or using the Service, you agree to comply with this AUP. Violation of this AUP may result in immediate suspension or termination without refund.
1. Permitted use
Customers may use the Service solely for:
- Internal business outreach and lead-generation activities
- Sales, marketing, and market research related to their real estate business
- Advertising audience matching where permitted by the relevant ad platform's policies
- Direct mail, email, telephone, and SMS outreach where lawful and consented
All use must comply with applicable federal, state, and local laws.
2. Prohibited uses
You may not use the Service to:
- Violate any applicable law or regulation
- Misrepresent the source, consent status, or purpose of the data
- Claim or imply that an individual requested direct contact from you
- Ignore "No Soliciting," "No Trespassing," opt-out, unsubscribe, or Do Not Call (DNC) notices
- Harass, threaten, deceive, or mislead individuals
- Engage in fraudulent, deceptive, or abusive conduct
- Use the data for robocalls, spam, or mass unsolicited messaging
- Resell, sublicense, rent, or redistribute the data
- Share login credentials or access with unauthorized parties
- Store, archive, or reuse data beyond the operational scope of the license
- Scrape, reverse engineer, or replicate datasets or methodologies
- Use the data to unlawfully target or exclude protected classes (including in real estate, fair-housing, or lending contexts)
- Bypass consent, privacy, or consumer-rights mechanisms
3. No transfer of consent
You acknowledge and agree that:
- Consent obtained during online form submissions or co-registration processes does not constitute consent to be contacted by you specifically
- Access to the Service does not grant permission to contact individuals using any particular method
- You are solely responsible for determining whether your outreach practices are lawful and for obtaining any additional consent required for your specific channel (TCPA-compliant prior express written consent for autodialed calls or SMS, CAN-SPAM-compliant footers and opt-outs for email, and so on)
The Company does not represent or warrant that the data is suitable for any specific outreach method.
4. No monitoring or compliance oversight
You acknowledge that the Company:
- Does not monitor or supervise customer outreach
- Does not control or supervise solicitation activities
- Does not provide legal or regulatory compliance advice
Customers are solely responsible for lawful use of the Service.
5. California-specific use requirements (CCPA / CPRA)
This section applies to Customers using the Service in connection with activities involving California residents.
5.1 Customer compliance obligations
Customers must comply with all applicable California laws, including but not limited to:
- California Consumer Privacy Act (CCPA)
- California Privacy Rights Act (CPRA)
- California Business & Professions Code provisions related to solicitation and real estate
- Do Not Call (DNC) and opt-out requirements
- Local and municipal solicitation restrictions
The Company does not provide compliance guidance or enforcement related to California law.
5.2 No sale or transfer of privacy rights
You may not:
- Represent that personal information was sold or transferred by the Company in a manner inconsistent with our Privacy Policy
- Use the data in a manner that would constitute unlawful "selling" or "sharing" under California law
- Attempt to bypass consumer privacy rights, including opt-out, deletion, or limitation requests
5.3 No service-provider or contractor relationship
You acknowledge and agree that:
- The Company is not acting as your service provider or contractor under California privacy law
- The Company does not determine the purposes or means of your data use
- You independently control all outreach activities and decisions
5.4 California-related indemnification
You agree to indemnify and hold harmless the Company from any claims, investigations, penalties, damages, or liabilities arising from:
- Your use of the Service involving California residents
- Alleged violations of California privacy or solicitation laws
- Consumer complaints, enforcement actions, or private claims
6. Enforcement & termination
The Company reserves the right to:
- Investigate suspected violations of this AUP
- Suspend or terminate access to the Service immediately
- Cooperate with law enforcement or regulatory authorities when required
Termination for violation of this AUP does not entitle the Customer to any refund.
7. Reporting violations
Suspected misuse of the Service may be reported to abuse@realestateintent.com.
8. Governing law
This AUP is governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.
